Gross breaches

In the case of suspected gross breaches of the School’s Regulations and Code of Conduct the Administrator Officer will immediately refer the case to the Principal who may deem it appropriate to suspend a student whilst the necessary investigation is carried out. The Principal will convene a disciplinary panel to comprise the Head’s nominee and at least two other senior members of staff and proceedings. The penalties that may be applied as an outcome of the disciplinary hearing.

If during the course of investigation or hearing within the School it should become clear that the situation in question is more serious than originally identified and is a suspected gross breach of the School’s Regulations and Code of Conduct, any proceedings should be terminated and immediate referral be made to the Principal. Investigation of all alleged breaches other than those covered. Any alleged breach of the School Regulations or Code of Conduct shall be the subject of a preliminary investigation. The purpose of the preliminary investigation is to determine whether any such breach has occurred, and, if so, may be dealt with by the person undertaking the investigation without the need for referral for formal disciplinary procedures.

Investigating Officers

The School will identify an appropriate Head of Subject or nominee outside the immediate subject area to carry out the preliminary investigation and record the name of the designated officer.

Outcomes following investigation

Following preliminary investigation the officer shall have the discretion to:

a) Dismiss the allegation.

b) Impose any fixed penalty permitted by the appropriate School regulations.

c) Refer for formal disciplinary proceedings to the School.

Process

The investigating officer shall gather information regarding the incident/allegation against the student with support of an administrative officer nominated by the School.

The ultimate responsibility for informing the student and managing the investigation lies with the investigating officer.

• The investigating officer shall arrange an interview with the student against whom allegations have been made.

• She/he shall confirm the arrangements for the meeting in writing to the student. The date of the meeting will be at least five working days from the date of posting the letter, which will also identify.

Penalties for Breaches of the Regulations or the Code of Conduct.

The penalties that may be imposed are as follows:

- A first warning of the possible consequences of further misconduct

(In this case a note of the incident will appear on the student record either for a specified time or permanently.)

- A written reprimand, with a copy of the letter being placed on the student

record either for a specified time or permanently

-  Withdrawal from a specific programme.

- Suspension, either for a specified period of time, or until specified conditions have been met.

- Expulsions

Note In the case of damage or theft the student will normally be required to

recompense the School. Recompense may include cash payments or some other form of contribution, e.g. replacement of equipment or working for the School. The amount involved will be shown as a debt to the School and the student is regarded as a ‘debtor’ for all relevant purposes.

Academic Penalties in Case of Cheating and Plagiarism

The penalty for cheating or plagiarism will be determined according to the seriousness of the offence and will take into account the stage of study within higher education. Thus where cheating or plagiarism in early stages may be considered within the context of developing appropriate scholarly behaviour, the same in later stages will attract the more severe penalties. The student’s previous record will also be taken into account.

In the case where cheating or plagiarism has been established the disciplinary panel will consider the application of penalties under the disciplinary procedures and determine the penalty to be applied. 

Where cheating or plagiarism has been established in any examination or formally assessed coursework, the assessment will be marked down or failed. The penalty applied will result in one of the following outcomes:

• those who will be present

• the purpose of the meeting

• the allegations that have been made and provide copies of any evidence.

• The investigating officer shall also refer the student to sources of advice available to them, the fact that they may be accompanied at the meeting by a friend or representative, and that they may bring a written account of their perception of events to the meeting.

• The investigating officer is responsible for identifying another independent academic member of staff to be present with them at the interview.

The substance of the allegation shall be discussed with the student at the investigative interview and the student shall be asked to present their perspective. A record of the meeting must be kept, signed and dated by both the officer and the student and the student given a copy.

If a student does not respond or attend then procedures under where a fixed penalty has been applied no other punitive action can be imposed. The student shall be entitled to appeal against the decision to apply a fixed penalty to the School.

Attendance Requirements

Students must attend all classroom lessons and work experience days to obtain their qualification. All non-attendance must be supported with a medical certificate or application to the principal in writing for leave of absence.

Should a student not attend more than 3 days without medical certificates or approval from the principal in writing, student will be deemed to have left the class and their position will be given to anyone on the waiting list.

As for international students under the Immigration Act, participants must not be absent for a continuous period of seven (7) days or more or that the percentage of attendance for the course in any of the month is 90 % or below without any valid reason. As the regulation for Security Bond, student require to surrender the student pass for cancellation if do not satisfy the attendance requirement.
